Federal Judge in California Blocks Biden Administration's new Asylum Border Rule, but Gives Administration Time to Appeal

KYMA-#AssociatedPress/DailyWire An Obama-appointed Federal Judge in California rules in favor of ACLU-represented platiffs over the Biden Administration's new asylum border rule. DailyWire.com linked to the 35 page decision from the U.S. District Court Northern District of California ruling by Judge Jon S. Tigar. The Biden Administration has been given time to appeal. The Court will "vacate the agency action and remand [the] agency" once any appeals has been exhausted. Additionally as such, the Judge orders a stay on the execution of the order for "14 days" - meaning the Biden Administration has 14 days to start the appeal process.

This action by the Judge nullifies the Biden's Administration's attempted new rule, whereby if a person did not enter at a port of entry and tried entry via an illegal border crossing, that person was not eligible to make an asylum request. This rule was blatantly illegal as the law is ~any asylum request is available at any time and any place~. It is very likely the Biden Administration already knew this was going to happen and has another ad-hoc-rule in waiting.
